1. Acceptance of Terms

By downloading, installing, or using the Tarqatoo mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Age Requirement: You must be at least 18 years old to create a parent account. The App is designed for students aged 11-17 years old, who may use the App only with parental consent and supervision.

2. Description of Service

Tarqatoo is an AI-powered educational tutoring application that helps students learn through guided questioning (Socratic method). The App:

• Provides educational assistance across various school subjects
• Does not provide direct answers but guides students to find solutions themselves
• Uses artificial intelligence to analyze questions and provide personalized learning support
• Allows parents to monitor their children's educational progress
• Offers photo capture functionality to submit homework problems

Important: Tarqatoo is a supplementary educational tool and does not replace formal education or professional tutoring services.

3. Account Types

3.1 Parent Accounts

• Created through Apple Sign-In, Google Sign-In, or email/password
• Required to manage children's profiles
• Responsible for all activities under child accounts
• Can subscribe to paid plans (Pro or Premium)

3.2 Child Accounts

• Created by parents through invitation codes
• No email or Apple ID required
• Device-based authentication
• Limited to users aged 11-17 years old
• Requires active parental supervision

4. Subscription Plans

4.4 Payment Terms

• All subscriptions are processed through Apple's App Store
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions through your Apple ID settings
• No refunds for partial subscription periods
• Prices shown in USD. Actual prices may vary by country and will be displayed in your local currency in the App Store.
• Prices are subject to change with notice

5. Acceptable Use

5.1 You Agree To:

• Provide accurate information during registration
• Maintain the security of your account credentials
• Supervise your child's use of the App
• Use the App only for lawful educational purposes
• Respect the intellectual property rights of others

5.2 You Agree NOT To:

• Share account credentials with unauthorized users
• Attempt to circumvent usage limits or subscription requirements
• Use the App to cheat on exams or assignments (App is designed to prevent this)
• Reverse engineer, decompile, or attempt to extract source code
• Use automated systems or bots to interact with the App
• Submit inappropriate, offensive, or harmful content
• Violate any applicable laws or regulations

6. Content and Intellectual Property

6.1 Your Content

• You retain ownership of any content you submit (questions, photos, messages)
• You grant Tarqatoo a license to use, store, and process your content to provide the service
• You represent that you have the right to submit all content

6.2 Our Content

• All App content, design, features, and functionality are owned by Tarqatoo
• Our trademarks, logos, and brand features are protected by intellectual property laws
• You may not use our intellectual property without written permission

6.3 AI-Generated Content

• Responses generated by the AI are provided for educational purposes only
• We do not guarantee the accuracy or completeness of AI-generated content
• AI responses should not be treated as professional advice

7. Privacy and Data Collection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

8. Third-Party Services

The App uses third-party services including:

• Firebase (Google): Authentication, database, cloud functions
• Google AI (Gemini): Primary AI-powered educational assistance
• OpenAI: Backup AI-powered educational assistance
• Apple Services: Authentication, payments, push notifications

Your use of these services is subject to their respective terms and privacy policies.

9. Parental Responsibilities

As a parent or guardian, you:

• Are responsible for monitoring your child's use of the App
• Must ensure your child uses the App appropriately
• Are liable for all activities under child accounts you create
• Should review chat histories periodically (Premium feature)
• Must not allow children under 11 years old to use the App

10. Limitation of Liability

10.1 Educational Use Only

• Tarqatoo is an educational tool and should not be solely relied upon for academic success
• We are not responsible for academic performance or outcomes
• The App is not a substitute for professional tutoring or formal education

10.2 Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The App will be uninterrupted or error-free
• AI responses will be accurate or complete
• The App will meet your specific educational needs
• Defects will be corrected

10.3 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TARQATOO SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of data, profits, or business opportunities
• Damages exceeding the amount you paid in the past 12 months

11. Account Termination

11.1 By You

• You may delete your account at any time through the App settings
• Canceling your subscription does not automatically delete your account
• Data deletion is governed by our Privacy Policy

11.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse or misuse the service
• Fail to pay subscription fees

12. Device Management

• Parents can manage up to 3 devices per child (Premium) or 1 device (Free/Pro)
• Devices can be revoked through parent settings
• Device tokens are securely stored and encrypted

13. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes through:

• In-app notification
• Email to your registered address
• Update to "Last Updated" date

Continued use of the App after changes constitutes acceptance of new Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

15. Dispute Resolution

15.1 Informal Resolution

Before filing a legal claim, you agree to contact us at contact@tarqatoo.com to attempt to resolve the dispute informally.

15.2 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.
